This site is owned by Lilley's Cider and registered in England, Registration No. Lilley's Cider 4759960, with registered address at Lilley's Cider, Roewood Farm, Bunns Lane, West Woodlands, Frome, Somerset, BA11 5ES, and email address at office@lilleyscider.co.uk. VAT Number 811378050.

Any purchase of goods from the site www.lilleyscider.co.uk requires the customer to consult and accept these terms and conditions. The click validating the order implies full acceptance of these terms and represents the customer's "digital signature".

ACCESSING OUR SITE

This site is maintained by Lilley's Cider for the personal use, of persons who are lawfully permitted to consume alcoholic beverages, in countries and other territories where the consumption of alcoholic beverages is lawful. By using our Site, you indicate that you accept these terms of use and that you agree to abide by them. Please exit our Site immediately if you do not accept these terms of use, or if you are not of a legal age for consuming alcoholic beverages in the country or other territory in which you are located, or are accessing our Site in a country or other territory where use of our Site is not permitted .If you choose, or you are provided with, a user identification code, password or any other piece of information as part of a registration scheme or a security procedure, you must treat such information as confidential, and you must not disclose it to any third party. We will not be responsible or liable, directly or indirectly, in any way for any loss or damage of any kind incurred as a result of, or in connection with, your failure to comply with this section of the Terms and Conditions. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these terms of use. From time to time, we may restrict access to some parts of our Site, or our entire site, to users who have registered with us.

ORDER CONFIRMATION

All contractual information will be confirmed by email to the address specified by the customer during the purchasing act.

ORDER AMENDMENTS/CANCELLATIONS

Please note that once your order has been confirmed & has reached our warehouse, we are unable to make any changes to your order. Such as product changes, additional items being added, delivery address amendments.

We cannot cancel your order once it has been processed beyond our office. If you no longer wish to progress with your order once it has reached our warehouse, please refuse your items when the courier attempts delivery & advise us by email (office@lilleyscider.co.uk) or by giving us a call (01373 466626). We will then arrange for your order to be returned to us & a refund will be given once it has reached our warehouse - please be advised this may take up to 7-10 working days to process. Please be aware that the delivery fee will not be refunded back to you if you have paid for the shipping of your order.

PAYPAL PAYMENTS / CLAIMS

If you have paid via PayPal eCheque - please note your goods will not be sent until the eCheque has cleared. For more info on eCheques please visit https://www.paypal.com/uk/smarthelp/article/why-has-my-payment-been-sent-as-an-echeque-faq962 If you wish for us to send this sooner please cancel your eCheque & place your order by calling us on 01373 466626 where we will take your payment details.

Please be aware if you are making a claim via PayPal that we only refund the price of the item if there are any issues. Damages/faulty items must still be emailed through to us to office@lilleyscider.co.uk along with information on the batch number, best before date, pictures of any damages/defects. Please also provide us with your order number & postcode as proof of identification. You will be asked to provide this information if you raise a claim via PayPal. Please if you are able email us before raising a claim, as this will be dealt with much quicker than going through the claim process or alternatively give us a call on 01373 466626.

PROOF OF TRANSACTION

The records stored in Lilley's Cider's computer systems under standard safety conditions are considered proof of communications, orders and payments made between the parties.

Purchase orders and invoices are stored on a reliable and durable system and can be produced as evidence.

PRODUCT INFORMATION

Every effort has been made to ensure the accuracy of the information presented on www.lilleyscider.co.uk. Lilley's Cider or its suppliers shall not be held liable for the consequences, accidents, or special damages arising from electronic transmissions or the accuracy of transmitted information, even in cases where Lilley's Cider was aware of the possibility of such damages. Manufacturer and brand names are only used for identification purposes. Product photos, descriptions and prices are non-contractual. Bag in boxed cider's to be consumed within 18 months from un-opened. Opened cider's to be consumed within 4-6 months. Bottled Cider's are labelled with a best before date. Unless otherwise stated, our Bag in Box products are non-carbonated & our bottled ciders are carbonated. A select few of our Lilley's bottles are however still ciders due to them being traditional in nature. We will not be held accountable for any recipe changes or information changes on behalf of other cider producers products. The cider should be kept in a cool, dry place to ensure extra fermentation doesn't take place.

VALIDITY PERIOD OF OFFER AND PRICES

Our offers and prices are valid for the day the site is consulted and are subject to change without notice.

DELIVERY TERMS

Products are delivered to the address specified by the customer on the purchase order and only to geographic zones that we service.

All products leave our premises in perfect condition. The customer must notify the carrier (or postman) of even the slightest trace of damage (holes, signs of crushing, etc.) to the parcel, and refuse the package if necessary. A new, identical product will then be sent to the customer at no additional charge. If your items are damaged upon opening the package, please retain the item. We may arrange for our courier to retrieve the item/s. Replacements will be sent upon receipt of a photo of your damages which can be sent to office@lilleycider.co.uk - please specify your order number and what/how exactly your cider is damaged.

No exchanges can be made at a later time for goods claiming to be damaged during carriage without notification at the time of reception.

As with any shipment, a delay or loss of goods is possible. In such a case, the carrier shall start an investigation. Every effort is made, for as long as necessary, to find the package. If the package is not found, the carrier will reimburse Lilley's Cider, who will deliver a new, identical package to the customer free of charge. We will not be held accountable for any damages that have occurred during transit & the delay in the parcel reaching the customer, a refund will not be given on the delivery fee if this occurs. The customer can choose between a new order of the damaged items or a full refund on both the items & the delivery fee.

We shall not be held responsible for delayed delivery times due to the carrier, including for the loss of goods, bad weather or strikes. Products are subject to availability Lilley's Cider will not sell or deliver alcohol to persons under 18 years of age. Delivery on order's during the week placed between the hours 8am-4pm will be delivered next working day Monday-Thursday. Orders placed on Friday before 3:30pm will be processed for delivery on the following Monday, after 4pm on Fridays the order will not be processed until the following Monday for delivery on the Tuesday. We currently do not offer a Saturday/Sunday delivery service. Please be aware that during peak times (Bank/Public Holiday's, Black Friday/Cyber Weekend, Christmas, New Year) allow up to 5 working days for delivery. This may also apply throughout December due to the high volume of orders. Currently we are only able to ship to the United Kingdom & EIRE due to excise legislations.

The courier will attempt delivery at your specified address twice. If both attempts are missed the courier will then hold your item/s at your local depot for 5 working days. If you wish to have your delivery reattempted then you may be asked to pay another shipping fee or alternatively you may need to collect from your local depot. If you wish for your item/s to be delivered to a new address unspecified on your order, you may be asked to pay a shipping fee. Non-delivered goods can take up to 5 working days to get back to us, then please allow a further 7-10 working days for your refund. Please be advised you may not have your shipping fee returned if the courier has been unable to deliver.

Free shipping applies to cider orders of over £60 only

We highly recommend leaving safe place instructions or nominating a neighbour to take your delivery as your parcel may be left with a neighbour or may be taken back to the depot if you're not home to accept the delivery & there are no suitable neighbours to accept. Please note in instructions if you would not like your parcel left.

PROOF OF AGE

You must be aged 18 or over to use our service. Our courier will require ID for proof of age if you look under the age of 21, please have your ID ready. Please ensure any neighbours that are accepting delivery also have ID to hand. Passports & UK Driving Licenses only. Our courier will return your parcel & your order will be cancelled/refunded if delivery is denied.

RETURNS

If you wish to return an order you must let us know within 14 days and return within 28 days of receiving it, if this time is exceeded Lilley’s Cider reserve the right to refuse a refund.

Please enclose your name, order number and the reason for returning your item.

After the item has been checked a member of the team will contact you with an update. Please note that if the item is found to be in poor condition (i.e. not resalable) Lilley’s Cider reserve the right to refuse a refund.

The cost of returning the item will not be covered by Lilley’s Cider unless the product was received in poor condition and photographic evidence has been provided. Please see ‘Faulty Returns’ below for more information.

A refund will be processed within 7 working days of receiving the items and a credit will reach your account within 7-10 working days.

FAULTY RETURNS / DAMAGES

We are very careful to ensure that your order is fulfilled correctly and that your package arrives in the same condition that it leaves our depot. However, occasionally, due to the delicate nature of the product, breakages do happen.

If you are not satisfied with your purchase please notify us within 28 days of receiving the order. Please send details of the issue, the batch number and use by date to office@lilleyscider.co.uk along with photographic proof. We may arrange collection of the goods via courier and a replacement will be sent upon receipt of your return, alternatively we will organise a refund if this is preferred. Please note without photographic evidence we are unable to resolve damages. If outer packaging only is damaged we may arrange to send you replacement packaging instead.

DELIVERY ERRORS

The customer must inform Lilley's Cider immediately (the same day or, at the latest, the first business day following delivery) concerning any claim of delivery error or non-conformity of goods, in kind or in quality, compared with the information on the purchase order.

Any claim made after this time period will be rejected.

All claims must be made in writing and sent to Lilley's Cider, Roewood Farm, Bunns Lane, West Woodlands, Frome, Somerset, BA11 5ES or alternatively you can email office@lilleyscider.co.uk

Any claim that does not respect the rules defined above cannot be taken into account and releases Lilley's Cider of any responsibility to the customer.

In the case of delivery error or exchange, all goods to be reviewed on a case by case basis where they may be exchanged or refunded. Goods must be returned to Lilley's Cider in whole, in its original packaging and in an aggreed & acceptable condition to Roewood Farm, Bunns Lane, West Woodlands, Frome, Somerset, BA11 5ES

For claims to be accepted, the customer must first make a declaration to Lilley's Cider concerning any returns and receive Lilley's Cider's consent. If accepted, the customer will ship the package to Roewood Farm, Bunns Lane, West Woodlands, Frome, Somerset, BA11 5ES.

Shipping fees shall be at Lilley's Cider's expense, except in the case where the goods do not correspond to the original declaration made by the customer concerning the return.

RIGHT OF USE

The use of any trademarks, logos or brands present on the site is strictly forbidden.

DATA PROTECTION

All personal data you provide us is used to process your orders. This data will be treated in accordance with the Data Protection principles outlined in the Data Protection Act 1998.

DISCOUNT CODES

Discount Code Terms apply. Code Validation periods apply. Codes cannot be used once the order has been processed. Discount codes to be entered in the Promotional Code box prior to checkout. Please check carefully before finalising your order. Lilley's Cider reserves the right to amend or withdraw offers/codes at its sole discretion Some products may not apply, includes Lilley's Advent Calendar / Guest Products (unless code is otherwise stipulated). Code applicable to one purchase only Discount codes not applicable to Trade customers unless otherwise stated.

Competitions

We have the right to withdraw competitions at our discretion. We will not be held accountable for scams impersonating us / copyright infringements using our logo/name. Our competitions are restricted to Mainland UK residents over 18 only. Competition validity will be stated on the competition details. Third party apps are used to determine winners at random based on entry requirements. Prizes are non-transferable, non-refundable & no cash alternative will be given.

APPLICABLE LAW AND COMPETENT JURISDICTION

In form and content, these Terms and Conditions shall be governed by and construed in accordance with English law. All orders placed on www.lilleyscider.co.uk strictly imply the acceptance of Lilley's Cider's terms and conditions.

In case of dispute or claim, the customer agrees to seek an amicable solution with Lilley's Cider before proceeding with any legal action. In the event where such a solution cannot be found, any disputes concerning the sale (price, Terms and Conditions, products, etc.) will be subject to the exclusive jurisdiction of the English courts.
